An important contributing factor in achieving a favorable outcome for your case includes having a good attorney.  Choosing the right lawyer to work with during the process is a vital step, but with so many options it’s easy to get overwhelmed and confused.  Here are a few things to look for when finding an attorney:

  1. Experience in practicing bankruptcy.  The number of years an attorney has practiced bankruptcy may give you an idea of how well they know the law. But, it doesn’t mean they consistently practiced bankruptcy law the entire duration.  This could make a difference in the type of in-depth knowledge they have.  The attorney should be experienced in consumer and small business bankruptcy law.
  2. Competency in bankruptcy law changes.  Some attorneys who claim to have experience working with bankruptcy cases may not be trained or up to par on all bankruptcy code revisions.  Many who actively continue improving their skills attend annual seminars to stay updated on law changes, with many being a member of the National Association of Consumer Bankruptcy Attorney’s (NACBA).
  3. A good listener.  Not only are you seeking assistance in managing your problem, you need someone who is willing to hear you loud and clear. Taking the time to listen to their client allows them to collect pertinent details to help lay down the foundation for your case.  An attorney should ask good questions to learn more about your situation. Be wary of a lawyer who tries to tell you what to do without hearing you out first.  Sometimes important details get missed and this could affect the outcome of your case.
  4. Offer specific advice regarding your circumstances.  In other words, while listening to you they should be able to provide advice based on facts you’ve presented in perspective with the bankruptcy law.
